battery problem

When running off the battery: At 40% remaining, the machine goes black and shuts down completely. There's no warning or low battery alert. The computer is not asleep; a hard reboot is necessary to bring it back to life.

We have attempted to condition the battery by putting the Mac into sleep mode until there's no more juice, and then completely recharging the battery. Despite this, the problem persists.

Does this mean that we need a new battery? Or is something else going on here?
